Louisiana Insurance & Injury Claims — Fall Update

Here is a brief update on what’s new for Louisiana Insurance and Injury Claims.

1) 51% Fault Rule (starts Jan 1, 2026)
If you’re found 51%+ at fault, you recover $0 for injuries. Current cases aren’t affected.
Tip: After a crash, don’t guess fault—document (photos/video/witnesses) and talk to us first.

2) “No Pay, No Play” got tougher (crashes on/after Aug 1, 2025)
If you were uninsured, Louisiana law now takes a bigger bite out of what you can recover—even if you weren’t at fault.
Tip: Stay insured and ask your agent to apply all discounts (bundle, safe-driver, telematics, roof/mitigation, etc.).

3) Causation proof matters more (incidents after May 28, 2025)
The old presumption that “new symptoms + quick treatment = crash caused it” is gone.
Tip: See a doctor within 24–48 hours, follow the plan, and ask your provider to note “related to [date of crash]” when appropriate.

4) Homeowners: Fortified roof credits
Upgraded to a FORTIFIED roof? Your IBHS certificate can qualify you for credits.
Tip: Keep your certificate handy and call your agent to apply it.

5) Small business/commercial vehicles
Dashcams/telematics may earn discounts (rolling in by 2026).
Tip: If you drive for work or manage a small fleet, plan installs and incident documentation now!
